Terms of Service

§ 1. General Provisions
1.1. These Terms of Service define the rules for using the website https://www.brandiff.io/ and the application available at https://app.brandiff.io/ (hereinafter: "Service").
1.2. The Service Administrator is Maciej Firuta conducting business under the name mfir.tech Maciej Firuta (hereinafter: "Administrator").
1.3. The Terms of Service are available free of charge in the Service in a manner that allows for their acquisition, reproduction, and recording.
1.4. Using the Service and application is equivalent to accepting these Terms of Service.
1.5. The Service and application are intended for use by entrepreneurs.
§ 2. Definitions
The following meanings are assigned to terms used in these Terms of Service:
2.1. Price List - a compilation of information about prices of Services provided by the Service Provider available in the Service in the "Pricing" section, constituting an integral part of the Terms of Service
2.2. Consumer - a natural person performing a legal transaction with an entrepreneur that is not directly related to their business or professional activity
2.3. Service Recipient Account/Account - part of the Service constituting a collection of resources and permissions assigned to a specific Service Recipient, accessible after logging in using a username and password
2.4. Billing Period - the period for which settlements of the Service Recipient's obligations for Services provided on a subscription basis are made (monthly or annual)
2.5. Subscription Fee - a fee paid by the Service Recipient in the amount specified in the Price List for using Services in a given Billing Period
2.6. Entrepreneur - a natural person who is not a Consumer, a legal person, or an organizational unit that is not a legal person but is granted legal capacity by separate legislation, conducting business activity
2.7. GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data
2.8. Service - the Brandiff.io website available at brandiff.io and its subdomain addresses
2.9. System - an IT solution being software available in the SaaS (Software as a Service) model provided by the Service Provider to the Service Recipient through the Service
2.10. Agreement - an agreement for the provision of Services electronically concluded remotely between the Service Provider and the Service Recipient, the subject and content of which are defined by the provisions of these Terms of Service
2.11. Services - free and paid services provided electronically through the Service by the Service Provider to the Service Recipient, consisting of providing access to the competitive analysis System
2.12. Service Recipient - an Entrepreneur who uses Services under the Agreement for purposes directly related to their business or professional activity
2.13. Service Provider - mfir.tech Maciej Firuta, providing Services electronically based on the Terms of Service
§ 3. Technical Requirements
Using the Service, including in particular using the Services, requires meeting the minimum technical requirements necessary for cooperation with the System:
- Having a functional device with an Internet connection (computer, tablet, smartphone)
- Permanent Internet connection with a minimum bandwidth of 5 Mbps
- Current and properly configured version of web browsers: Chrome 120+, Firefox 120+, Safari 16+, Edge 120+
- Having an active email address
- Enabled support for cookies and JavaScript
- Screen resolution minimum 1024x768 pixels
§ 4. Service Usage Rules
4.1. The application serves to present the offer of competitive analysis services and enables contact with the Administrator.
4.2. Competitive analyses are prepared based on publicly available data, including content from websites entered by the Service Recipient. This data is processed using OpenAI artificial intelligence technology, and the analysis results presented in the application are generated on this basis. The Service Provider is not responsible for the correctness, timeliness, or completeness of the analyzed data or for results generated by AI systems.
4.3. The Service Recipient undertakes to use the Service in accordance with the law, good practices, and these Terms of Service.
4.4. The Service Provider provides Services continuously 7 days a week, subject to service breaks. Planned service breaks will be communicated 24 hours in advance.
4.5. It is forbidden to:
- Use the Service in a manner contrary to law or these Terms of Service
- Introduce content to the Service that is unlawful, harmful, or offensive
- Violate copyrights, trademarks, or other intellectual property rights
- Impersonate other persons or provide false information
- Distribute viruses, malware, or other harmful codes
- Take actions that may disrupt or damage the functioning of the Service
§ 5. Service Recipient Account
5.1. Registration in the Brandiff.io application is voluntary.
5.2. Adults and minors with the consent of a legal representative are entitled to register.
5.3. During registration, the Service Recipient undertakes to provide true, current, and complete information.
5.4. The Service Recipient is responsible for maintaining the confidentiality of access data to their Account.
5.5. The Service Provider reserves the right to delete the Account in case of violation of the Terms of Service.
§ 6. Paid Services
6.1. Access to the service requires purchasing a subscription.
6.2. Subscription plans are available at the following prices:
- Starter - 199 PLN/month
- Growth - 499 PLN/month
- Enterprise - 999 PLN/month
6.3. Payments are collected cyclically according to the selected subscription plan.
6.4. The Service Recipient may cancel the subscription or change the subscription plan at any time. Cancellation does not result in a refund for the current billing period.
§ 7. Payments
7.1. The Service Recipient is obliged to pay for the paid Service in advance according to the Price List. In case of non-payment, the Service Provider has the right to withdraw from the Agreement and cancel the order.
7.2. The Service Provider enables payment in the following forms: credit card payments (Visa, Mastercard).
7.3. The moment of payment is considered to be the date of crediting the payment to the Service Provider's bank account.
7.4. Costs related to payment processing are borne by the Service Recipient.
7.5. The Service Provider will issue an invoice to the Service Recipient based on the data, including the tax identification number, provided during registration of the Service Recipient's Account.
7.6. The Service Provider will promptly deliver the invoice to the Service Recipient at the email address provided by them.
7.7. The Service Recipient consents to receiving invoices from the Service Provider electronically, in accordance with Article 106n paragraph 1 of the Act of March 11, 2004 on tax on goods and services.
7.8. Any changes regarding Subscription Fees will be announced in the Service by publishing the current Price List with 30 days' notice.
7.9. In order to commence the provision of services, the Service Recipient is required to accept the following clause:
"I declare that I have been informed about my right to withdraw from the agreement within 14 days from the date of its conclusion, in accordance with the Act of May 30, 2014 on consumer rights. At the same time, I expressly consent to the commencement of the provision of electronic services before the expiry of the withdrawal period and acknowledge that upon full performance of the service I will lose the right to withdraw from the agreement".
7.10. The Service Recipient is aware that in case of non-acceptance of the clause mentioned in point 7.9, the service will be activated after the expiry of the fourteen-day period.
§ 8. Copyright and Intellectual Property
8.1. The Service Provider reserves that both the Service and the System contain content protected by intellectual property law (graphic elements, logos, computer programs).
8.2. Using the Service does not mean acquiring any rights to intangible assets for works found in the Service. Without obtaining prior consent from the Service Provider, it is forbidden to copy, distribute, use, or modify any components of the Service or System.
8.3. The Service Provider grants the Service Recipient only a non-exclusive license authorizing the use of the Service and System in a manner consistent with its intended purpose, including on the terms specified in the Terms of Service.
8.4. The license is granted by the Service Provider without territorial restrictions for a definite period corresponding to the period of providing the Service of access to the System and expires upon deletion of the Service Recipient's Account.
8.5. The "Brandiff.io" brand and logo are trademarks of the Service Provider.
§ 9. Liability
9.1. The Service Provider will make every effort to ensure that the Service operates continuously and without errors, but does not guarantee the absence of technical interruptions.
9.2. The Service Provider is not liable for:
- Damages resulting from improper use of the Service
- Data loss caused by the Service Recipient's actions
- Damages caused by third parties
- Interruptions in Service operation due to technical reasons
- Lost profits
- Indirect or consequential damages
- Business decisions made based on data from the Service
- Incorrectness, outdatedness, or incompleteness of analyses based on public data
- Consequences of actions taken based on competitive analyses
- Errors, inaccuracies, or irregularities in results generated by artificial intelligence systems
- Interpretations or conclusions presented by AI technologies
9.3. The Service Recipient bears full responsibility for content they introduce and for the consequences of their actions in the Service.
9.4. The Service Provider is not liable for interruptions in the provision of Services or disruptions in access to the Service caused by force majeure (fire, natural disasters, epidemic, war), failures of Internet infrastructure, interruptions in electricity supply, or Internet connectivity.
9.5. The Service Provider's liability for damages is limited to the amount of fees paid by the Service Recipient for the 12-month period preceding the event causing the damage.
§ 10. Personal Data Protection
10.1. The principles of personal data processing are defined in thePrivacy Policywhich constitutes an integral part of these Terms of Service.
10.2. Using the Service may involve the processing of personal data in accordance with applicable law, including GDPR.
§ 11. Complaints
11.1. Complaints regarding the functioning of the Service can be submitted to: maciej.firuta@mfir.tech
11.2. The complaint should contain:
- Contact details of the person submitting the complaint
- Description of the problem or irregularity
- User's request
11.3. The Service Provider will consider the complaint within 14 business days from its receipt.
11.4. The response to the complaint will be sent to the email address provided in the complaint.
§ 12. Changes to Terms of Service
12.1. The Service Provider reserves the right to make changes to the content of the Terms of Service, subject to the protection of acquired rights.
12.2. The Service Provider will inform Service Recipients about changes to the Terms of Service no later than 14 days before their planned entry into force by displaying a message and publishing the new Terms of Service in the Service and sending information about the planned change electronically to the email address assigned to the Service Recipient's Account.
12.3. Lack of objection from the Service Recipient to the proposed changes within 14 days of notification is equivalent to acceptance of the new Terms of Service. In case of objection, the Agreement terminates on the day preceding the entry into force of the new Terms of Service.
§ 13. Final Provisions
13.1. In matters not regulated by these Terms of Service, the provisions of Polish law shall apply.
13.2. All disputes will be resolved by the court with jurisdiction over the Administrator's registered office.
13.3. If any provision of the Terms of Service proves to be invalid, the remaining provisions remain in force.
13.4. The Terms of Service enter into force on the date of publication in the Service.
